Terms and conditions

Article 1 — Purpose and scope

These terms govern the relationship between L&S SAS (trading as Love & Seed), registered at 38 rue Charles de Gaulle, 88200 Remiremont, France, SIREN 130 421 662, hereafter "the Seller", and any adult natural person acting as a consumer who makes a purchase on loveandseed.fr, hereafter "the Customer".

Placing an order implies unreserved acceptance of these terms in the version in force on the day of the order.

Article 2 — Adults only

Sales are strictly limited to persons aged 18 or over. By confirming an order, the Customer certifies that they meet this condition. The Seller reserves the right to cancel any order where there is serious doubt as to the Customer's age.

Article 3 — Products

The products offered are hemp-based products with a THC content below 0.3%, in accordance with French law and Regulation (EU) 2021/2115.

They are not medicines, food supplements or foodstuffs. They are not intended for combustion. No health claim is associated with their sale.

Product photographs are not contractually binding: natural material varies in colour and texture from batch to batch.

Article 4 — Prices

Prices are shown in euros, all taxes included, excluding delivery charges. Delivery charges are displayed before final confirmation of the order.

The Seller may change prices at any time; products are invoiced at the rates in force when the order is recorded.

Article 5 — Orders

The order process comprises product selection, entry of delivery details, choice of delivery method, choice of payment method, then confirmation. Confirmation constitutes acceptance of the price and of these terms.

A confirmation email summarising the order is sent to the address provided by the Customer.

Article 6 — Payment

Payment is due immediately upon ordering. The accepted payment method is bank card — Visa, Mastercard and Carte Bleue, including contactless and 3-D Secure.

Payment takes place on a secure page hosted by Viva.com, an electronic money institution authorised in the European Union. The Customer briefly leaves the site to enter their card details, then is brought back once the payment has either gone through or been declined.

Card details are handled directly by the payment provider and never pass through nor are stored by the Seller.

Article 7 — Delivery

Orders are packed by hand and handed to the carrier within 24 working hours of payment being received. An order placed on Friday afternoon therefore ships on Monday.

Packaging

Every parcel ships in opaque packaging, with no logo, no mention of the contents and no reference to hemp on the label. The sender shown on the waybill is L&S, with no mention of the trading name or of the contents. This discretion is systematic: it does not have to be requested.

Carriers, lead times and charges

Mainland France — Colissimo tracked. Indicative 48 to 72 hours after dispatch. €5.95. Free delivery from €50.

Europe — Colissimo International. Indicative 4 to 8 working days depending on destination. €12.90.

Europe — Mondial Relay. Pickup-point delivery. Indicative 4 to 7 working days. €7.90.

Countries served: Belgium, Luxembourg, Germany, Spain, Italy, the Netherlands, Austria, Portugal, Ireland. Lead times are indicative and do not include any customs holds. A tracking number is emailed as soon as the parcel is handed to the carrier.

Collection in store

An order may be paid online and collected at the shop, 38 rue Charles de Gaulle, 88200 Remiremont, during opening hours. Collection is free of charge. It is offered as a delivery method at checkout; the order is prepared and set aside as soon as payment is received.

Same-day local delivery

Love & Seed delivers in person, every day, along the Moselle valley from Golbey to Le Thillot, including Remiremont and the towns in between. This service does not use a carrier: it is carried out by the shop itself.

Payment is made on handover, in cash or by card. Cash is accepted up to €1,000 per transaction (article L.112-6 of the French Monetary and Financial Code).

Requests are made online or through the shop's Telegram channel. A request is not an order: the sale is concluded at the moment of handover and payment, in the Customer's presence. Love & Seed first confirms whether the address is eligible, the delivery window and the applicable charge; without that confirmation, no delivery is owed.

Address eligibility is confirmed case by case: the 10-kilometre boundary does not follow administrative town limits.

Local legality

The rules applying to hemp products vary from one State to another, including within the European Union. Customers residing outside France are solely responsible for checking that importation is lawful before ordering.

Lost or damaged parcels

If a parcel is not delivered within the announced lead time, or arrives damaged, the Customer writes to contact@loveandseed.fr quoting their order number. An enquiry is opened with the carrier; depending on its outcome, the order is reshipped or refunded.

Article 8 — Right of withdrawal

Under articles L.221-18 et seq. of the French Consumer Code, the Customer has fourteen days from receipt of the order to exercise their right of withdrawal, without having to give a reason.

Important exception: under article L.221-28 5° of the French Consumer Code, the right of withdrawal cannot be exercised on goods unsealed by the consumer after delivery which cannot be returned for reasons of hygiene or health protection. Opened pouches fall within this case.

To exercise this right, the Customer informs the Seller by email at contact@loveandseed.fr. Products are returned, in their original sealed packaging, to: Love & Seed — 38 rue Charles de Gaulle, 88200 Remiremont, France. Return shipping is at the Customer's expense.

Refunds are issued within fourteen days of receipt of the return, using the same payment method as the original order.

Article 9 — Legal guarantees

The Seller is bound by the legal guarantee of conformity (articles L.217-3 et seq. of the French Consumer Code) and the guarantee against hidden defects (articles 1641 et seq. of the French Civil Code).

Article 10 — Liability

The Seller cannot be held liable for any use of the products contrary to their intended purpose, nor for the Customer's failure to observe the regulations applicable in their country of residence. Customers residing outside France are responsible for verifying that importing the ordered products is lawful.

Article 11 — Personal data

The processing of personal data is described in the privacy policy.

Article 12 — Governing law and disputes

These terms are governed by French law. In the event of a dispute, the Customer may use free consumer mediation under the conditions set out in the legal notice.

Appendix — Model withdrawal form

The Client is not required to use this form: an unambiguous e-mail is enough.

Complete and return this form only if you wish to withdraw from the contract.
